License grant and restrictions
You are requested to agree to use the CD-ROM under the following license agreement. Aqua Image grants you, and your employer a non-transferable, non-exclusive, perpetual license to store, reproduce and use the specific photographic image(s) that you have purchased for your own commercial or non-commercial use during this transaction.

You are granted to
Use the images on a worldwide, unlimited and perpetual basis for advertising and promotional materials, packaging; media, web-design, broadcasting, publishing; materials for personal, non-commercial use.

You are not granted to
Sublicense, re-license, rent or lease, copy or publish any of the Images to third parties separate or independent from a specific product, website, or similar. You will have to retrieve Extended License Rights promptly from Aqua Image when the image was used against it. Use the Images in commercial products to produce a significant part of the re-sale value of the product (i.e., postcards, posters, calendars, etc.). For this kind of usages of the Image you may acquire an extended one-time Commercial Product Image License from the Aqua Image and/or its authorized sales agent. Use for pornographic, defamatory, libelous or otherwise unlawful;

Warranty and disclaimer
Aqua Image warrants the digital copy of the Images stored on this CD-ROM to be free from defects in material. But when some defects found, it will be replaced to new CD-ROM. However, it is limited for 30 days after purchasing the CD-ROM. Aqua Image makes no other warranty. Neither Aqua Image nor its licensors shall be liable to you or any other person or for any claim of a third party and for claims caused by the use of the Images. Reservation of rights and protection of intellectual property All rights to the Images possessed by Aqua Image are protected by Japan copyright laws, international treaty provisions and other related laws. Aqua Image retains all rights not expressly granted under this Agreement. You may be held legally responsible for any copyright infringement caused or encouraged by your failure to abide by the terms of this Agreement.
