What is Royalty-Free?
Royalty-free is an industry standard term used to describe a class
of images used for any type of project. You may use the images as
often as you like. You do not own the copyright to the images, but
instead own a license to use the images wherever and whenever you
want with a few restrictions. Royalty-free is hassle free because
you do not have to continually contact the photography agency or original
copyright holder for pricing and permission each time you want to
use the images.
What are the restrictions?
The only restrictions for royalty-free are that you cannot use the
images in any application that is defamatory or pornographic. You
cannot resell the images, or give copies of the images to another
party. You can use the images for any advertising, marketing or editorial
purposes but you cannot resell the images or create products based
on the images for resale. For example, it is legal to use the images
in ads, product packaging, billboards and brochures but not legal
to create postcards, T-shirts, greeting cards or calendars based on
the images. If you plan on using the images for product that will
be sold, you need a resale license from us. To get a resale license
is quite easy, simply contact us through phone or email and leave
a brief description of the intended project, proposed production and
distribution so we can negotiate a price.
What are the advantages or disadvantages to Royalty-Free?
The main advantage to royalty-free stock photography is the affordable
pricing and ready-to-go availability of the images. It is easy to
browse through our website for the type of image you are looking for,
once you find it you can acquire the image quite easily and quickly.
The affordable pricing allows you to work within smaller budgets.
When buying an entire collection you get many great images at one
incredible price. The only disadvantage to royalty-free is that the
usage of these images is not managed and therefore may be used by
many other designers all around the world. Also due to the affordable
pricing, these images are often sold much more often than Copyright-Protected
images. If you need a great image at an affordable price royalty-free
is definitely the way to go. If you need a more original or unique
image that is not distributed as freely, it is best to go with one
of our Copyright-Protected images.

EpicImagesOnline.com is not in any way responsible for poor printing
quality due to the many variables beyond our control throughout the
design, prepress and printing processes. We have taken great steps
to produce the best quality cmyk digital images. Our images have been
scanned and color corrected for traditional cmyk SWOP-coated offset
printing. We individually adjust and proof each image to ensure great
quality. Our images should reproduce very well in print, but due to
many variables outside our control throughout the design, pre-press
and printing processes, the final outcome could produce undesirable
results. We recommend for you to use only reputable printers who maintain
precise color calibration throughout their proofing devices, imagesetters
and printing presses. We recommend to have color calibrated proofs
run before the press run and it is also advised to do a press-check
when possible. Consult with your printer on the different choices
of paper because this can also affect the final output quality.
EpicImagesOnline.com End User License Agreement:
The following terms of this usage agreement contract are basic common
sense and an industry standard. If you do not fully understand all
the contents of this contract, please contact us and we will be happy
to answer any questions. This is a legal agreement between you and
EpicImagesOnline.com. Please carefully read and fully understand this
entire agreement before you purchase, copy or download any content
from us, or from any other media on which we deliver our content.
If you do not agree to all the following terms, please do not utilize
the imagery provided. Imagery is defined as a single image, image(s),
composite images, motion, film or video footage, or any other visual
or audio representation. This license agreement contract is not only
between you and EpicImagesOnline.com but also a legal agreement involving
your employer. If you as an individual purchases or downloads any
imagery from us, you and your employer must abide by the terms of
this agreement. If you leave the employer who makes the purchase the
employer may continue to use the imagery but you may not take or copy
the imagery for use at another employer or for your own company.
Use of Comp Images
'Comp' is an industry standard term used to describe an image that
is used for a sample. This sample may be used to show clients or supervisors
to relay the concept of a future project in order to obtain permission
to purchase the licensed image. Comps can also be used to test a design
idea. Comps cannot be used in final pieces for circulation within
a company or outside media or marketing. Comps also cannot be used
as an example of another artists work. Comps cannot be distributed
to any other parties. You may use Comps to develop your own personal
design portfolio in sample pieces only. Comps can never be used as
final images in any presentation other than your own personal portfolio
to obtain employment or freelance work for yourself. Basically, do
not steal our comping images. If you like an image you must obtain
a license to use it.
Licensed Images Usage
Upon payment you may use your licensed images for use including brochures,
ads, billboards, CD covers, book covers, kit covers, graphic design,
internal presentations, internet, intranet, extranet, television,
multimedia, film and video projects. These images are only licensed
to one company and cannot be resold, given away or transferred to
another company. As a design firm or ad agency you may use the images
for multiple clients as you are the license holder. You cannot however
transfer the images to a client for their use on future projects.
Multiple employees in the same company may use the images. Without
a resale license, you cannot create objects based on the images, for
resale. This includes postcards, greeting cards, posters, calendars,
stationary, mousepads, premium items and T-shirts. To obtain a resale
license please contact us (info@epicimagesonline.com) and provide
a brief description of your intended project and itÕs distribution.
You can post the images on a company server or network for multiple
employee usage for up to 10 employees at one location. For further
locations or additional employees please contact us to obtain a seat
license upgrade.
Restricted Usage
When purchasing images from EpicImagesOnline.com you are not actually
buying the copyright to the images but simply purchasing a license
to use the images in accordance to our Usage Agreement. You absolutely
cannot resell the images in part or in whole or as a manipulated version
of our images. You cannot create objects based on the images for resale.
You cannot lease or sub-license the images to another party. You cannot
give copies of these images to other parties. If you or your firm
uses these images in a clientÕs project, you cannot give the client
copies of the images for future use aside from work you do for them.
They must obtain a license to use the images on their own. You absolutely
agree not to use any images in a defamatory manner or context. They
cannot be used in any pornographic or obscene use, or in conjunction
with any other materials that may be deemed to be pornographic or
defamatory, either by changing it or by any accompanying text. Because
your use is out of our control you agree to hold EpicImagesOnline.com
and its vendors/agents harmless of any and all claims against your
usage of our images. If you use any of our imagery without purchasing
the imagery prior to the use you assume full responsibility for any
and all claims against the said use. We do require you to seek advanced
written permission for use of any content for sensitive subjects including
but not limited to contraception, matters of a sexual nature, substance
abuse, domestic abuse, alcohol, tobacco, AIDS, cancer and other serious
physical or mental ailments. EpicImagesOnline.com reserves the right
not to permit reproduction of any content for any reason whatsoever.
As we have fully made all necessary arrangements for securing model
releases, property releases and made the best judgements possible
in accordance to copyrights and trademarks of designs, logos, products
and such shown in our imagery, it is the full responsibility of you
as the end user to make appropriate and responsible judgements concerning
your usage of our images.
Copyright of Imagery
Our website, media and anything we produce are copyrighted and protected
by the intellectual property laws of the United States and the Berne
Convention. The usage rights for any final production must be purchased
and payment received prior to publication. The use of content is licensed,
not sold, and the content remains the sole and exclusive property
of EpicImagesOnline.com or the copyright holder. You agree not to
make, authorize or permit any use of any content, except for comp
purposes, until usage rights have been obtained and payment received.
Content use without prior payment is a copyright violation.
Copyright Protection
All images are the property of EpicImagesOnline.com and to protect
the copyrights of these images all usage editorially & commercially
must show the proper photo credit: Photo: EpicImagesOnline.com
Unauthorized Use
Because it is difficult to determine damages resulting from unauthorized
usage, the stock imagery industry as adapted a standard fine for the
use of imagery without proper payment. In the case of images used
prior to payment of license to use them, we will not accept less than
ten (10) times the normal license fee plus attorneyÕs fees and all
associated costs. You will be invoiced for this amount and without
payment of this fine we will file suit and criminal charges against
you. Any reselling or unauthorized distribution of our images is a
criminal offense and will be dealt with accordingly.
Payment Terms
All payment must be paid through our website store, phone or email
order. We accept Visa, Mastercard, American Express and Discover credit
cards through our merchant account. You can also mail in a Cashier's
Check or Money Order with a description of your order. All credit
card sales must be approved before we send the merchandise out. Contact
us if you would like to set up an account to establish a line of credit.
A line of credit will only be granted after a credit check. We retain
the right to refuse credit to anyone for whatever reason we see fit.

The above terms are governed by Article 2 of the Uniform Commercial
Code.
