This is an agreement ("Agreement") by and between you and Datacraft Co., Ltd. (hereinafter "Datacraft") regarding the royalty free copyrighted images and its digital data (hereinafter the "Image" and "Image Data," respectively) which you purchase. You are deemed to have agreed to the terms and conditions of this Agreement when you purchase the Image and are entitled to use the Image Data pursuant to the following terms and conditions.

All copyrights to the Image and Image Data will remain the exclusive property of Datacraft and/or its suppliers. You shall not acquire any rights, title, or interest in or to the Image or Image Data, or any authority to grant a license to a third party for the use of the Image or Image Data, except as expressly set forth herein.

• This license permits only you to use the Image Data. You may not sell, distribute, rent or lease the Image Data.
• You may use the Image Data, with or without modification, for the purposes of your own use or provision of your products, merchandise or other items ("Items") to your clients, as part of leaflets, brochures, pamphlets and any other printed matters for advertisement of products and services, part of package design, website design and for other similar purposes, either for commercial or non-commercial purposes, subject to the below; provided that when you provide your client with Items using Image Data, you will ensure that your client will use the Image Data without any modification and will use the Image Date, in compliance with the terms and conditions of this Agreement.
• You are not required to affix a notice of credit for Datacraft or title of Service when you use the Image Data.

• You may not use the Image Data, with or without modification, in any manner specified below ;
  • To make and sell any products that are identical or similar to the Service which includes but is not limited to, distributing the Image Data as independent items or as printed matters, including, but is not limited to an image collection, photo collection or their samples.
  • To use the Image Data in a manner that may give a false impression that you have copyright to the Image Data or a licensing authority for the Image Data.
  • To use the Image Data in a way that may enable a third party to use or download the Image Data which includes, but is not limited to, incorporating it into wallpaper or screensaver for personal computers or other digital devices, incorporating it into image data that is to be bundled into hardware, software or books, or using it in services providing templates.
  • To provide Image Data, with or without resizing or any other modifications, for a mobile devise or for web sites for mobile devices, including but not limited to, for any standby screen and mobile applications.
  • To use or provide the Image Data for on-demand products or services, including without limitation, printing services, greeting cards, blog making services, digital signage and other items, in any manner or by any media, including, without limitation, brochure, CD-ROM, Internet, mobile phone and other terminals.
  • To create and/or distribute a product that is identical or similar to the subject of the Image (for example, a reproduction of the subject of the Image on fabric or a paper) by using the Image Data.
  • To print the Image Data and distribute it for display or ornamental use, or transfer the Image Data to a third party who subsequently prints and uses the Image Data for his/her display or ornamental use.
• You are prohibited from installing the Image Data on a hard disk that is accessible by multiple personal computers connected by LAN, and thereby enabling the use of the Image Data through multiple personal computers.
• You may not use the Image as a part of a trademark or service mark, corporate name, or any other identification product or service, or register the Image as a trademark or a corporate name or in any manner whatsoever.
• You may not use the Image or Image Data in any manner that is against public order or good morals or for the purpose of any business or activity that is against public order or good morals. You may not use any of the Image or Image Data in or on any adult magazine, adult video or other adult media, in any manner, including, without limitation, on a cover, or in an article, or advertisement, regardless of whether or not such use is against public order or good morals. Nor may you use the Image or Image Data for pornography or sexual entertainment, regardless of whether by an individual or by a corporation, in any manner including, without limitation, on a cover, package, or in an article, visual image, or advertisement.
• You may not use any of the Image Data in any manner that may cause any harm to the outlook, feature, dignity, fame or reputation of any subject of the Image (a subject includes but is not limited to an individual, article, or landscape). You are specifically prohibited from using any of the Image or Image Data in any manner that may give an impression that the subject of the Image had actually used or endorsed any specific product or service.
• You may not use any subject of the Image in any other article, visual image, or advertisement that, in whole or in part, is based on false expression, or constitutes defamation, libel or slander, or other illegal conduct.
• If you are not sure whether your act will fall under the aforementioned prohibited matters, please contact Datacraft. • You acknowledge that Datacraft does not provide you with any guarantee regarding the Image data. In no event shall Datacraft be liable for any impediments, accidents, or any loss or damage which are caused from or in connection with the Service or use of the Image Data.
• The caption or explanatory information (e.g., geographic or other name) attached to the Image Data is the information at the time of photography or creation of the Image Data. Some Image Data may be in the form of computer graphics, satellite photo, composite picture, or any other modified or altered image. Datacraft does not guarantee accuracy of the Image or the foregoing information academically, technically or from any other perspective.
• You acknowledge that your sole remedy for any defect in the Image Data shall be the replacement of the Image Data with a substitute (the latest version of the Image Data when the replacement is claimed) without defect and Datacraft disclaims any other liabilities and remedies with respect to any defect in the Image Data.
• In the event that you are in violation of any terms or conditions of this Agreement, Datacraft shall be entitled to immediately terminate this Agreement without prior notice, and you may not use the Image Data thereafter.
• You acknowledge that Datacraft may change the Image data which are provided in the Service without prior notice, and therefore the Image Data may become unavailable at any time. Please refer to the latest information on the website (http://imagenavi.jp/).
• This Agreement shall be governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have an exclusive jurisdiction over any and all disputes arising in connection with the Service or this Agreement.
